Terms
Before your transaction can be completed, you must read and agree to these terms and conditions. By purchasing from a Merchant utilizing the payment services of CCBill, you agree to these terms and conditions and agree to be legally bound by them. Changes are effective when posted.
1. Legal Definitions
Consumer: The individual purchasing goods from the Seller.
Merchant: The operator or owner of the storefront to which the Consumer
purchases goods.
Products: Goods, tangible or intangible, purchased from and fulfilled by
a Merchant to a Consumer.
CCBill Pay: An online service offered to the Consumer enabling the
storage of multiple payment instruments that can be used within CCBill's
Merchant Network.
User Profile: A CCBill Pay Consumer profile opened and used by the
Consumer. It incorporates the Consumer's personal information, including
email address, password, full name, home address, payment information,
and other information.
Payment Instrument: A payment method or tool enabling the transfer of
funds.
2. Description of Services
CCBill provides transaction processing between a Merchant and a Consumer. The Merchant provides and fulfills products purchased by a Consumer. The Merchant is responsible for fulfillment and customer support. CCBill is not responsible for the Merchant's products, fulfillment, or claims about those products. Questions about products should be directed to the Merchant using the contact information it provides.
3. Billing
CCBill and the Merchant may jointly appear on the Consumer's statement for charges made. Each Merchant charge for a product purchased will appear as described at the time of purchase. CCBill may include other information on a statement as required by applicable rules and regulations.
If the Consumer elects to use a bank account to purchase a product, a debit will be presented to that bank account.
4. Payment and Fees
Products may have recurring fees, which the Merchant defines and discloses at the time of the initial purchase. The Consumer is responsible for fees according to the terms accepted at purchase.
Product pricing appears on the website associated with the item. Returns and refunds are governed by the Merchant's terms and conditions. Product or delivery issues should be directed to the Merchant.
5. Automatic Recurring Billing
If selected by the Consumer on the sign-up page, recurring fees may renew at the end of the original term for a similar period unless notice is received before renewal. Trial or special-offer recurring fees renew at the rate stated at purchase.
Until the agreement is cancelled, the Consumer authorizes CCBill to charge the chosen payment method for recurring charges and additional purchases provided by the Merchant.
6. Electronic Receipt
CCBill will email a transaction receipt to the email address provided during purchase. A Consumer may request a complete copy of charges. Contact information is provided below.
7. Cancellation
Recurring transactions may be terminated by CCBill, the Merchant, or the Consumer upon notification by electronic or conventional mail, telephone, or fax. When the Consumer requests termination, past recurring fees are not refunded. Consumers are liable for charges incurred until termination.
If a Consumer requests cancellation or a refund due to unauthorized or fraudulent use, CCBill may, at its discretion, block the Consumer's information from use by CCBill merchants to prevent further unauthorized use. This does not prevent unauthorized use at merchants that do not use CCBill and is not a substitute for contacting the appropriate channels to prevent further misuse.
8. Refunds
When a Consumer requests termination of a recurring transaction, past recurring fees are not refundable. If a refund is issued by the Merchant or CCBill, it will be credited to the payment method used for the original transaction. CCBill will not issue refunds by cash, check, or to another credit card or payment mechanism.
9. Authorization of Use
Products are provided for personal use and may not be used for commercial purposes or by commercial entities unless authorized by the Merchant. Redistribution is prohibited.
CCBill and the Merchant reserve the right to terminate a purchase if these terms are breached. In that event, the Consumer may be required to destroy information or products received.
10. Age-Restricted Products and Material
Products may be intended only for individuals who are of legal age in the jurisdiction where the material is viewed and at least 18 years old in the United States (21 in Alabama, Mississippi, Nebraska, and Wyoming). Products may include graphic visual depictions and should not be accessed by anyone who is not of legal age.
11. Supplementary Terms and Conditions
The Merchant may have additional terms and conditions that form an integral part of its offering to the Consumer. Those terms apply in addition to these terms.
By acknowledging CCBill's terms and conditions, the Consumer confirms that they have read and understood the terms and authorizes CCBill to bill the chosen payment method as described at purchase.
The agreement between CCBill and the Consumer is governed by the laws of the State of Arizona, with venue in Maricopa County, Arizona, U.S.A., for disputes arising out of or relating to CCBill's services.
Anything prohibited/illegal will not be allowed on the site.
12. Severability
If any provision of this agreement is held invalid or unenforceable, the remaining provisions continue in effect. A court may limit an invalid provision so that it becomes valid and enforceable.
13. Notice
